Learned counsel for the petitioner fairly submits that the issue involved in this Writ Petition is squarely covered by the Order dated 28.02.2017 of this Court in Writ Petition No. 11771 of 2008 and batch, wherein the similar claim made by the petitioners therein was dismissed.

In view of the fair submission, this Writ Petition is also dismissed in terms of the Order dated 28.02.2017 in Writ Petition No. 11771 of 2008 and batch. No costs.

Consequently, the miscellaneous Applications, if any shall also stand dismissed.
