The case of the petitioner is that the petitioner's fair price authorisation was suspended by the 3rd respondent vide proceedings dated 10.11.2016 in R.C.No.2032/2016 CS. Against the same, the petitioner filed an appeal before the 2nd respondent along with stay petition. As no orders are passed in the same, the present writ petition is filed. Learned counsel for the petitioner submits that the variations found in the stocks are minor in nature and that there is no proper accounting of the kerosene oil in the impugned show cause notice. He also submits that statutory appeal filed by the petitioner is pending before the 2nd respondent.
Heard the learned Government Pleader for Civil Supplies. In view of the above facts and circumstances, this writ petition is disposed of directing the 2nd respondent to dispose of the appeal filed by the petitioner within a period of four (04) weeks from the date of receipt of copy of this order. Till then, there shall be stay of operation of the impugned proceedings dated 10.11.2016. The petitioner shall cooperate with the disposal of the appeal. In case, the petitioner does not cooperate, it is open for the appellate authority to dispose of the appeal in accordance with law. However, this orders will not
preclude the authorities to complete the enquiry in pursuance to the show cause notice dated 10.11.2016. No costs.
