HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.8588 of 2018 ORDER :

This criminal petition filed under Section 438 Cr.P.C. by the petitioners/A.1 and A.2 in Crime No.298 of 2017 of Subedari Police Station, Warangal Commissionerate, registered for the offences punishable under Sections 324, 307 and 506 read with 34 IPC, which is out come of a private complaint of the de facto complainant, dated --.07.2017 by mentioning the sections of law mentioned in the said private complaint supra.

The alleged occurrence of Section 307 IPC is stated taken place on 18.03.2016. The private complaint is about 15 months thereafter. Though this is the contention in saying it is a false accusation, as pointed by learned Public Prosecutor, already the petitioners moved the quash petition in Crl.P.No.7158 of 2017 and the same is pending before another Bench of this Court, where there was interim direction of stay of investigation for six weeks. The petitioners submit that applications for extension of the interim stay of investigation filed pending. Once such is the case, there is nothing to consider the anticipatory bail application, but for to dispose of the criminal petition to work the remedy in the quash petition.

Accordingly, the criminal petition is disposed of. The police are directed to not to arrest the petitioners for six (6) weeks from today.
