The petitioner alleges that respondents 3 to 5 are undertaking illegal construction without appropriate building permission.

Learned counsel for the petitioner submits that on account of the illegal construction taken up by respondents 3 to 5, grave prejudice would cause to the petitioner and moreover the respondents are threatening to block the nala and therefore during the rainy season, there is possibility of blockage of nala water inundating in the locality.

Having regard to the said submission, it is apparent that the petitioner has no direct grievance against respondents 3 to 5 and his right is not directly affected from the alleged illegal construction. The petitioner is not a neighbour of respondents 3 to 5, but is a resident of the colony. The cause espoused in the Writ Petition is in the nature of affecting the locality at large. Therefore, the Writ Petition is not maintainable and the same is liable to be dismissed. In such a case, the petitioner has to avail appropriate remedies.

Hence, the Writ Petition is dismissed giving liberty to the petitioner to institute a Public Interest Litigation, if so advised. There shall be no order as to costs.

Miscellaneous petitions, if any, filed in this Writ Petition shall stand closed.
