C.Geetanjali, v. The State Of Andhra Pradesh,
THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.28896 of 2017 ORDER:
Heard the learned counsel for petitioner and the learned Government Pleader for Revenue appearing for respondents. 2.
Petitioner's grievance is that petitioner had applied for survey to the 3rd respondent on 15-06-2017 in Sy.No.649 of Nellore Village and Mandal of extent Ac.44.32 cents and the 3rd redpondent had not conducted any survey in spite of the fact that the petitioner paid requisite charges therefore.
3. Learned Government Pleader for Revenue appearing for respondents states that the land claimed by the petitioner is covered by forest and it is not possible to do survey.
4.
This contention of the 3rd respondent is not correct having regard to the adangal for the year 2010-11 filed by petitioners, (the contents of which are not disputed by the learned Government Pleader), which shows that the land in question is wet land and there are also sub-divisions in the said land.
5. It is not known on what basis instructions are given to the learned Government Pleader contrary to the revenue records maintained by respondents.
6.
Therefore the Writ Petition is allowed with costs of Rs.1,000/- (Rupees One Thousand only) to be paid by 4th respondent to the
MSR,J W.P.No.28896 of 2017 petitioner and a direction is given to the 4th respondent to cause a survey to be conducted as sought by petitioner in his application dt.16-06-2017 in respect of land in Sy.No.649 of Nellore Village, within six (06) weeks from the date of receipt of a copy of this order. 7.
As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
