Learned counsel for the parties have agreed for disposal of this appeal by the following order: "Respondents shall not take any action against the structure in question, which has been completed by the appellant in view of the interim order, dated 13.03.2009, without following due process of law. In other words, it is open to the respondents to initiate action against the construction made by the appellant during the pendency of the appeal and in view of the interim order, dated 13.03.2009, in accordance with law."

Writ Appeal is disposed of.

Consequently, miscellaneous petitions, if any, also stand disposed of. No order as to costs.
