This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 seeking bail to the petitioners who are arrayed as Accused Nos. 1 & 2 in the event of his arrest in Crime No.748 of 2022 on the file of Station House Officer, Alwal police t Station, Cyberabad, registered for the offence punishable under Sections 323,506 of IPC and Section 3 (1)(s) of pOA against SC & ST Act.

Heard learned counsel for petitioners/Accused Nos.1 & 2 and learned Additional Public Prosecutor for respondent-State. perused the record.

Learned Public Prosecutor submits that notice was served on respondent No.Z/defacto complainant.

Since the punishment prescribed for the offences alleged against the petitioners are up to seven years, without going into the merits of the matter, the respondent-police are directed to carry out the investigation by following the procedure as contemplated under
Crl.Petition No. 9725 of ZOZI Section 41-A Cr.p.C and the guidelines formulated by the Hon,ble Supreme Court in case of Arnesh Kumar u. State of Bihalscrupulously. It is needless to say, any deviation in this regard will be viewed seriously.
Accordingly, the Criminal petition is disposed of. 5.
