HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.6886 OF 2016 ORDER:

The grievance of the petitioner is that his possession and enjoyment of the land over an extent of Ac.4.00 gts in Sy. No.95/A, Chowdavaram Village, Vemsoor Mandal, Khammam District, is sought to be interfered under the 'Mission Kakatiya Project' without issuing any notice, without acquiring the land and without payment of any compensation to the petitioner.

Learned counsel for the petitioner places reliance on the order dated 08.02.2016 passed by this Court in W.P.M.P.No.4780 of 2016 in W.P.No.3741 of 2016.

Learned Government Pleader for Respondents, on written instructions, received from the Executive Engineer, I.B Division, Sathupally, Khammam District, submits that the boundary excavation work in Sy.No.94 has already been completed and the tank is located in Sy.No.94 and hence there is no interference by the officials of the respondents. In that view of the matter, it is made clear that no work shall be undertaken by the officials of the respondents in Sy.No.95 without putting the petitioner on notice and without acquiring the land by paying the due compensation.

Accordingly, the writ petition is disposed of directing the respondents not to undertake any works in Sy.No.95 without putting the petitioner on notice and without acquiring the land by paying the due compensation. No order as to costs.

In view of the disposal of the main writ petition, Miscellaneous Petitions, if any pending in this writ petition shall also stand closed. ______________________________ CHALLA KODANDA RAM,J Date:03.03.2016.
