HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.20744 OF 2016 ORDER:

The order under challenge is suspension pending enquiry dated 16.06.2016. The petitioner is authorized dealer of fair price Shop No.19 of Paletipadu Village, Jarugumalli Mandal, Prakasam District since 1975. While so, based on the report submitted by the 4th respondent - Tahsildar, the 3rd respondent issued a show cause notice on 16.06.2016 levelling certain irregularities, to which the petitioner submitted his explanation, but the 3rd respondent did not receive the same and suspended his authorization by order dated 16.06.2016. Aggrieved by the same, the petitioner filed the present writ petition. Heard learned counsel for the petitioner and learned Government Pleader. Learned counsel for the petitioner submitted that without receiving the petitioner's explanation and without hearing him, the impugned order was passed.

Hence, the impugned order may be suspended. In view of the above, the writ petition is disposed of permitting the petitioner to file his explanation within a period of three weeks from the date of receipt of a copy of this order and the respondents shall receive the same. Thereafter, the respondents are directed to complete the enquiry and pass final orders after considering the explanation submitted by the petitioner within a period of three weeks from the date of receipt of the explanation by duly observing the principles of natural justice and affording an opportunity of being heard to the petitioner. There shall be no order as to costs.

Miscellaneous petitions, if any pending in the writ petition, shall stand closed. ______________________________ CHALLA KODANDA RAM, J.
