HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.28872 OF 2018 ORDER:

The present writ petition came to be filed seeking to declare the action of the respondents in trying to allot the land of the petitioners admeasuring Ac.45.28 cents situated at Sy.Nos.33/1, 2 and 34 of Karollapadu Village, Pamuru Mandal, Prakasam District, as illegal and arbitrary.

When the matter is taken up for hearing, learned Government Pleader for Revenue, placed on record the written instructions received from Tahsildar, from Tahsildar, Pamur Mandal. In so far as the land in Sy.Nos.33/1 and 33/2 of Karollapadu Village, Pamuru Mandal, Prakasam District, is concerned the names of the petitioners do not figure as owners of the land. In so far as the land in Sy.No.34 is concerned, the names of the petitioners figure at Sl.Nos.7 and 10 and the extent of holding by them is Ac.0.60 cents each. It is further stated that the petitioner filed a suit in O.S.No.117 of 2017 before the Junior Civil Judge, Kanigiri and also R.O.R appeal in Rc.B/2234/2017 before the Revenue Divisional Officer, Kandukuru which are pending adjudication.

Having regard to the facts and circumstances of the case and in view of Section 8(2) of the Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1971, the proper remedy for the petitioners is only to get the dispute adjudicated before the civil court. Hence, I see no merits in the writ petition. Accordingly, the writ petition is dismissed. No order as to costs. As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
