HON'BLE DR. JUSTICE B. SIVA SANKARA RAO WRIT PETITION Nos.18592 & 18649 of 2017 COMMON ORDER:

Heard learned counsel for the petitioner in both the writ petitions and also the learned Government Pleader for Civil Supplies for respondents and perused the prayer in the respective writ petitions with the supporting affidavits and other material on record.

The prayer in the writ petitions indicating by impugned proceedings Nos.B.1689 & 1690/2017 dated 24.05.2017 pending enquiry, the 3rd respondent RDO suspended the authorization of the petitioners and the said order is illegal and unsustainable, but for to pass any final order.

Perused the legal position submitted by the learned Government Pleader in several expressions right from 1996 including the latest one in W.P.No.36774 of 2015 in G. Sridevi Vs. The State of A.P., Civil Supplies Department and Others, which clearly says the Courts got discretionary power subject to factual matrix though the suspension pending enquiry shall not ordinarily exceed 90 days, but for in exceptional circumstances to assign reasons to go beyond. Having regard to the above and from the perusal of hearing, there are no exceptional circumstances made out.

Accordingly and in the result, the Writ Petition is disposed and the respondents are directed to pass final order within four

(04) weeks from the date of receipt of a copy of this order, if it could not be, the suspension order ceases its force till passing of final orders. Any further grievance of the petitioners is left open.

Dr. SSRB,J Consequently, miscellaneous petitions, if any, shall stand closed. No costs.
