HON'BLE SRI JUSTICE G. SHYAM PRASAD CIVIL REVISION PETITION No. 425 OF 2011 ORDER:
This Civil Revision petition is arising out of the order, dated 27-01-2011 passed in E.P.No.135 of 2010 in O.S.No.277 of 2008 on the file of Junior Civil Judge, Gajuwaka.
The Civil Revision Petition has been admitted on 11-02-2011 and in CRPMP.No.610 of 2011, interim stay has been granted subject to condition to deposit 1/3rd of the EP amount by the end of March, 2011 with certain conditions. Thereafter, the matter has been called on 17-09-2016, the petitioner was called absent and there is no representation on his behalf and the matter was directed to be posted under the caption 'for dismissal'. On 23-09-2016 again the matter is called and none appeared for the petitioner, though the matter is posted under the dismissal caption. Even today, when the matter is coming-up for hearing, learned counsel for the petitioner is absent and no representation on behalf of the petitioner. It is not known whether the conditions imposed in CRPMP.No.610 of 2011 have been complied with or not.
Since this matter is posted for dismissal twice and there is no representation on behalf of the petitioner, it appears that the petitioner is not intending to prosecute the case in further. Hence, the Civil Revision Petition is dismissed for non-prosecution. In consequence, miscellaneous petitions, if any, pending in this Civil Revision Petition, shall stand dismissed as infructuous. No order as to costs.
