HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P.No.70 of 2016 ORDER:

This petition is filed to withdraw O.P.No.161 of 2015 from the file of Principal Senior Civil Judge, Tenali, Guntur District, and transfer the same to Senior Civil Judge, Nandigama, Krishna District.

2. Wife filed this petition. According to her affidavit, she filed D.V.C.No.1 of 2015 and C.C.No.179 of 2014 and both the cases are pending before Judicial First Class Magistrate, Jaggaiahpeta and respondent is attending for these two cases, but respondent-husband filed O.P.No.161 of 2015 before Principal Senior Civil Judge, Tenali, for restitution of conjugal rights. She stated that she is having three children and presently staying in Jaggaiahpeta Mandal and it will be difficult for her to attend before the Court at Tenali and Senior Civil Judge, Nandigama, is at a distance of 15 km. from her residence, therefore, she prayed for transfer of O.P.No.161 of 2015 from Principal Senior Civil Judge, Tenali, to Senior Civil Judge, Nandigama.

3. Respondent did not file any counter disputing the affidavit averments of petitioner.

4. Heard both sides.

5. Considering the reasons stated in the affidavit filed in support of petition and also considering the

convenience of wife, O.P.No.161 of 2015 is withdrawn from Principal Senior Civil Judge, Tenali, Guntur District, and transferred to Senior Civil Judge, Nandigama, Krishna District, for disposal in accordance with law.

7. Accordingly, transfer C.M.P. is ordered.

8. Miscellaneous petitions pending, if any, shall stand closed.
