HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.15795 OF 2017 ORDER:

This writ petition is filed declaring the action of the respondents in serving the impugned lease termination notice dated 06.03.2017, as illegal and arbitrary.

Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue. It is to be seen that petitioner is questioning the notice issued in pursuance to the lease agreement entered between him and the respondents. This Court while exercising power under Article 226 of Constitution of India cannot go into disputed questions of fact arising out of the terms and conditions of the contract entered between the petitioner and the respondents. Petitioner has alternate remedy by way of approaching Civil Court.

In view of the same, I do not see any reason to entertain the writ petition. Accordingly, the writ petition is dismissed. There shall be no order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 27.04.2017 dv
