HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 45150 of 2016 ORDER:

Petitioner - firm seeks a direction to respondent No.2 to consider their application dated 14.11.2016 seeking exemption of tax on their vehicles.

Learned Counsel for the petitioner submits that the subject vehicles were hypothecated to the Indian Bank, Challapalli Branch, Krishna District, for availing loan and, as EMIs were not paid, banker took possession of vehicles on 21.06.2013; and, as there was settlement between the petitioner - firm and banker and since they have to ply the vehicles on road, they made application dated 14.11.2016 to respondent No.2, and the same has not been considered till date.

Learned Government Pleader for Transport would submit that the application of the petitioner would be considered and necessary orders would be passed in accordance with law.

In the circumstances, the Writ Petition is disposed of directing respondent No.2 to consider the application of the petitioner - firm dated 14.11.2016, in accordance with law, within a period of six weeks from the date of receipt of a copy of this order. No order as to costs.

Miscellaneous petitions pending, if any, shall stand dismissed. No order as to costs.
