HON'BLE SMT. JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION No.9834 of 2015 ORDER:

This writ petition is filed to declare the action of the respondents in terminating the agreement dated 9.7.2008 entered into by the petitioner with the 3rd respondent for improvements to Wankidi-Kagaznagar road via Kamana from KM 10/6 to 22/4 including major and minor CD works in Adilabad District, vide impugned Lr.No.AB/A2/EEM/2014-15/1606 dt.10.3.2015 of the 4th respondent.

When the matter came up for hearing, learned Government, based on instructions issued to him by the 4th respondent/Executive Engineer dated 28.11.2018, submitted that as the petitioner has failed to complete the work within the agreement period, the contract was terminated under clause 60(a) of P.S. to APDSS and that the balance work was sanctioned under separate scheme and the work is in progress. In view of the written instructions of the 4th respondent, learned counsel for the petitioner seeks liberty to avail the other remedies available to him under law.

Accordingly, the Writ Petition is disposed of granting liberty to the petitioner to pursue the remedies which are available to him under law. No order as to costs.
