THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.27050 OF 2017 ORDER:

The writ petition is filed seeking to declare the interference of the respondents 4 and 5 with the personal life and liberty of the petitioner as illegal and arbitrary.

When the matter is taken up for hearing, the learned Government Pleader for Home (T.S) had placed on record the written instructions which reads as follows:

"Pursuant to 100 dial call, immediately, the Inspector of Police, Saifabad Police Station, Hyderabad deputed police patrolling party to the said area and enquired the matter. At that time, the petitioner herein on one side and Mr. Surabhi Suman Reddy (son of the petitioner herein) were quarrelling with each other regarding their family dispute and hence both the parties were advised to maintain peace in the area.

Except advising both the parties, they were never summoned them to the police station nor registered any case against them.

It is submitted that having bore grudge against his wife-7th respondent the petitioner made false and baseless allegations against the respondent police; that no complaint whatsoever was received or registered against the petitioner herein nor he was summoned to the police station at any point of time. To prevent the police from taking any action in the event of lodging of any complaint against him in future by the respondents 6 and 7 herein, the petitioner rushed to this Court on mere apprehension and file the present writ petition.

It is pertinent to submit that the dispute of the petitioner as well as the unofficial respondents is purely family dispute and more particularly civil in nature and hence this respondent police are no way concerned with it.

The petitioner herein is not at all required in any case registered on the file of Saifabad Police Station and no case whatsoever was registered against him till date.

All the other allegations made in the affidavit are false, exaggerated, concocted and hence totally denied." Recording the above said instructions, the writ petition is closed. Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
