HON'BLE SRI JUSTICE S.V. BHATT Writ Petition No.19185 of 2017 ORDER:

The petitioners filed appeal against the order of 3rd respondent in RCE.2/ 790/ 2004 dated 02.04.2017, before 2nd respondent vide Appeal No.BCW1/ 80/ 2017 dated 22.05.2017 along with the stay application for interim prayer. The petitioners allege that the officials of the 5th respondent are trying to dispossess the petitioners from the subject property. Having regard to the urgency in the matter, the instant writ petition is filed praying for expeditious consideration and disposal of the stay petition filed by the petitioners in appeal against the order of 3rd respondent.

2. I have perused the material on record and I am satisfied that the petitioners have made out a case for direction.

3. Hence, the 2nd respondent is directed to take up and pass orders on the stay application filed by the petitioners in the pending appeal, within one week from the date of receipt of a copy of this order. The petitioners are given liberty to file a memo by enclosing a copy of this order for a date in the stay application.

4. The writ petition is, accordingly, disposed of. No order as to costs. Miscellaneous petitions, if any, pending in this petition, shall stand dismissed.
