SUJANA CRIMINAL PETITION No.13058 of 2025 This Criminal Petition is filed before this Court for grant of bail to the Petitioner who is arrayed as accused in FIR No.1099 of 2025 of KPHB Colony Police Station, Cyberabad Commissionerate, registered for the offence punishable under Section 69 of BNS.

The brief facts of the case are that the de-facto complainant is the father of the victim. The accused and his daughter (victim) are studying in the same college in different section doing the same course and accused had developed intimacy with his daughter. Further, on 11.08.2025, the accused took his daughter to a Hotel Room at Kukatpally, where the Hotel Management after verifying the Aadhar Card refused to give the room and from there he took his daughter to room at 9th phase, Golden Elite Hotel, KPHB, where the room was already booked on his name, which was reserved through online and the time was around 11 a.m. Further, the accused promised her to marry and told all Chameleon stories and forced his daughter for Intimacy. All of a sudden she started Bleeding profusely and the accused took her to the
hospital. When the de-facto complainant asked about the identity of the accused, his daughter refused to disclose, then he got her discharged from Hospital. Later, she disclosed his name as Ankhit Sharma. Hence, he requested to take necessary action. Basing on the said complaint, the police registered a case for the above said offence. 3.
Heard Sri P. Vikasraj, learned counsel appearing on behalf of the petitioner/accused as well as Sri E. Ganesh, learned Assistant Public Prosecutor for respondent-State. 4.
Learned counsel for the petitioner submitted that the relationship between the victim and the accused is the consensual relationship. It is further submitted that the petitioner is ready to marry the victim and he is in jail from 29.08.2025 and the material part of the investigation was already completed. Therefore, he prayed the Court to grant bail to the petitioner by allowing this criminal petition. 5.
On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner stating that the allegation leveled against the petitioner are serious in nature, because of the said offence, the victim was severely suffered and was also admitted to the
hospital. Further, the investigation is not yet completed. Therefore, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the petitioner is in jail from 29.08.2025. Further, as seen from the record, the material part of the investigation was already completed and 14 witnesses were already examined. Considering the facts and circumstances of the case, the nature of the allegations, the stage of investigation, and the duration of incarceration, this Court finds it appropriate to grant bail to the petitioner/accused, subject to the following conditions. i.
The petitioner/ accused shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum each to the satisfaction of the learned IV AJCJCum-XV Additional Judicial Magistrate of First Class, at
Kukatpally, Medchal-Malkajgiri District.
ii.
The petitioner/ accused shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.
iii.
The petitioner/ accused shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
