THE HON'BLE SRI JUSTICE P.KESHAVA RAO WRIT PETITION No.17057 OF 2015 ORDER:

Heard the learned counsel for the petitioner as well as the learned Government Pleader appearing for the respondents 1 to 4. The prayer sought for in the writ petition is as under: " to issue Writ Order or Direction more particularly one in the nature of Writ of Mandamus to declare the action of the Respondent No. 2 & 3 in not allotting the 100Sq.yds. of land backside of the residence of the petitioner i.e. SRT No. 146, Jawahar Nagar, Chikkadpallly, Hyderabad which is not for public purpose and which is unobjectionable land in favour of the petitioner is illegal, arbitrary and unconstitutional and consequently direct the Respondent No. 2 & 3 not to allot the 100 Sq.yds. of land backside of the residence of the petitioner i.e. SRT No. 146, Jawahar Nagar, Chikkadpallly, Hyderabad to any third parties" .

During the course of hearing, the learned Government Pleader brought to the notice of this Court that the orders issued by the Government in G.O.Ms.No.166 Revenue (Assn.POT) Department, dated 16.02.2008 relating to transfer of rights on certain occupations/ encroachments of specified categories of unassigned Government lands on payment basis, has been withdrawn. Therefore, the petitioner is not entitled for allotment of 100 sq.yds. of land as sought for in the writ petition. In that view of the matter, this Court is of the opinion that no further cause would survive for adjudication in the writ petition and the same is accordingly dismissed. No costs.
