HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.28889 of 2018 ORDER:

This writ petition is filed challenging the action of the 1st respondent in passing the impugned order for externment of the petitioner and directing him to remove himself outside the Krishna District for a period of six months.

Admittedly the petitioner has alternative remedy of appeal under Section 6 of the Andhra Pradesh Prevention of Anti Social and Hazardous Activities Act, 1980 (for short "the Act"). But learned counsel for the petitioner says that the respondents have not followed the provisions of the Act in passing the impugned order and the petitioner is not a goonda within the meaning of Section 2 (e) (i) read with explanation of the Act. It is not the case of the petitioner that the authority, who passed the impugned order lacks jurisdiction. All the contentions raised can be examined by the appellate authority.

In view of the same, this writ petition is disposed of granting liberty to the petitioner to avail alternative remedy of appeal under Section 6 of the Act. In view of the pendency of this writ petition, the petitioner is granted (15) days time to file the appeal. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
