HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.29175 of 2018 ORDER:

This Writ Petition is filed seeking to declare the action of respondent No.1 in interfering with the matrimonial disputes pending between the petitioner and respondent No.3 and providing police aid to respondent No.3 for taking custody of his son, without any Court order or without following due process of law, as arbitrary and illegal.

Learned Assistant Government Pleader for Home produced written instructions, wherein it is stated that basing on the complaint of 3rd respondent, dated 11.08.2018, against the petitioner, the Station House Officer, Mylavaram Police Station addressed a letter to the Chairman, Mandal Legal Services Committee, XV Additional District Judge, Nuzvid, to issue notice to both parties for conducting counselling as it is a matrimonial issue. It is further stated respondent No.1 is not interfering with the matrimonial disputes pending between the petitioner and the 3rd respondent and also not accompanied with the respondent No.3 for taking child back.

Recording the same, the Writ Petition is disposed of directing the respondents not to interfere with the matrimonial disputes pending between the petitioner and the 3rd respondent. It is needless to observe that the petitioner can file an application for custody of her son.
