WRIT PETITION No.2756 of 2016 ORDER :

The 2nd petitioner is seeking compassionate appointment on the ground that 1st petitioner was declared as unfit to work as a driver and on medical grounds. Subsequently though alternative employment was given as Shramik, he was discharged from the said post on account of his disability. By relying on the scheme introduced on 03.06.2015, 1st petitioner claims that the compassionate appointment should be provided to the 2nd petitioner. 2nd petitioner claims to have submitted representations on 14.07.2015, 08.10.2015 and 17.11.2015 seeking for appointment on compassionate grounds. But so far the said representations are not disposed of.

2. Learned Standing counsel submits that the circular instructions dated 03.06.2015 may not be applicable to the petitioners, since the 1st petitioner has already opted for alternative employment subsequently. According to the averments of the petitioners in the affidavit filed in support of the writ petition, the 1st petitioner is drawing full salary.

3. Be that as it may, since the 2nd petitioner has already submitted representations and the same are pending consideration, without expressing any opinion on merits, the writ petition is disposed of directing the 2nd respondent to dispose of the said representations as expeditiously as possible, preferably within a period of six (6) weeks from the date of receipt of copy of this order. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
