HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL REVISION CASE No.922 of 2017 ORDER :

The revision is maintained impugning the order passed by the II Additional Judicial First Class Magistrate, Rajahmundry, dated 16.03.2017 in C.C. wrongly mentioned instead of C.C.No.279 of 2014 as if C.C.No.297 of 2014, which is clear from the material papers page No.6 of the note wrongly put up by so mentioning of the concerned clerk and the learned Magistrate instead of verifying did not go through. It is purely an act of the Court shall prejudice no man based on the latin maxim actus curiae neminem gravabit.

Having regard to the above, to avoid making of mountain out of moul hill, the Criminal Revision Case is disposed of before admission, directing the lower Court to give correct C.C.No. by virtue of this order and serve copy to the accused by granting one month time to pay the cheque amount else to enforce under Section 421 r/ w 431 Cr.P.C.
