THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.30258 of 2017 ORDER:
Heard learned counsel for the petitioner and the learned Government Pleader for Prohibition & Excise (A.P.). Petitioner herein is the licencee of A4 shop at D.No.3-99/1 of Gorripudi Village, Karapa Mandal, East Godavari District. Obviously he is aggrieved by the proposal of the official respondents herein in permitting the unofficial respondents to shift his A4 shop from D.No.9-276, Velangi G.Bandaru Road to D.No.3-99/1 of Gorripudi Village.
When the matter is taken up, written instructions, furnished by the Prohibition & Excise Superintendent, Kakinada-third respondent herein vide Rc.No.A3/55/2017 dated 12.09.2017 to the office of the learned Government Pleader have been placed on record. In the said instructions, it is stated that the Assistant Prohibition & Excise Superintendent, Kakinada concluded that he personally verified the premises and found that the proposed premises of the unofficial respondents is in accordance with the Rules. The fact remains that no final orders have been passed so far. In view of the same, this Court deems it appropriate to keep it open to the petitioner herein to submit all objections for the said proposal of shifting within a period of one
week from today. If any such objections are filed by the petitioner within the time stipulated above, the same may be considered and appropriate action be taken, strictly in accordance with law, after giving notice to all the stakeholders. Accordingly, the Writ Petition is disposed of. Miscellaneous petitions, if any, pending in the Writ Petition, shall stand closed. There shall be no order as to costs.
