THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.5087 OF 2016 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Revenue.

The petitioner claims to be in possession of Acs.3.29 guntas in Survey No.101/A of Mahadevapur Village and Mandal, Karimnagar District. The present Writ Petition is filed challenging the possession certificate dated 27.06.2015, issued by the Tahsildar, Mahadevapur Mandal, Karimnagar District, the 3rd respondent, in favour the of the 4th respondent. The petitioner states that the said certificate is issued without notice to him; the same affects his right, title and possession; the certificate is factually incorrect and on that basis, the revenue record is being updated in favour of the 4th respondent.

I do not see any reason to entertain the Writ Petition as the said certificate was not issued by the 3rd respondent by exercising any statutory power but the same was issued on the request of the 4th respondent after making enquiry from the Village Revenue Officer. In any case, if the petitioner has any legal right and possession, it is for him to assert the same by initiating appropriate proceedings either before the competent civil Court or before the revenue authorities, questioning the possession certificate said to have been issued in favour of the 4th respondent.

With the liberty as aforesaid, the Writ Petition is dismissed. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this Writ Petition shall

stand closed.
