THE HON'BLE SRI JUSTICE SURESH KUMAR KAIT WRIT PETITION No.29135 of 2016 ORDER:

Vide present petition, petitioner seeks Mandamus declaring the action of the respondent authorities in fixing the market value in respect of petitioners' lands in survey Nos.176 and 480/2 of Nadupuru Village, Peda Gantyada Mandal, Visakhapatnam District, to an extent of Acs.40.00 cents at Rs.12 lakhs per acre contrary to the proceedings of the respondents dated 08.07.2016 as against the prevailing market value of Rs.30 lakhs per acre.

Heard the learned counsel for the petitioner. Learned Government Pleader for Revenue takes notice for respondent Nos.1, 4 to 6. Learned Government Pleader for Medical & Health Department takes notice for R.2 and Smt.A.Jayanthi, learned Standing Counsel, takes notice for R.3.

Learned counsel appearing for the petitioners submits that the petitioners being aggrieved over the statement showing particulars of Encroachers/Assignees of land in survey No.480 of Nadupuru Village of Pedagantyada Mandal (referred to at page No.51 of the material papers as Ex.P-8), made representation dated 06.08.2016 to The District Collector-4th respondent, however, till date no communication, in response thereto, is received from the respondents.

Learned Government Pleader for Revenue assures this Court that a decision will be taken on the representation

dated 06.08.2016 positively within two weeks and the same will be communicated to the petitioners herein.

Keeping in view the averments made in the writ petition and also after hearing the counsel for respective parties, I hereby direct the respondent Nos.2 and 4 to act on the representation of the petitioners dated 06.08.2016, decide the same within two weeks from the date of receipt of a copy of this order and the decision taken thereof shall be communicated to the petitioners in writing within one week thereafter.

Till communication of the decision taken by the respondents to the petitioners, petitioners shall not be dispossessed from their respective lands. It is needless to mention that if the petitioners are still aggrieved over the decision taken by respondent Nos.2 and 4, they are at liberty to approach appropriate Forum seeking appropriate relief permissible under Law.

Accordingly, the Writ Petition is disposed of. No order as to costs.

Miscellaneous petitions pending in the writ petition, if any, also stand closed.
