THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.9096 OF 2017 ORDER:

This Writ Petition is filed seeking to declare the action of respondents in levying Cross Subsidy Surcharge on the energy drawn by the petitioner - Company through Open Access during the month of March, August and September, 2012, as illegal and arbitrary.

Heard learned counsel for the petitioner and Sri R. Vinod Reddy, learned counsel for the respondents. 3.

The case of the petitioner - Company is that though it filed a representation on 13.10.2016 ventilating its grievance, no orders are passed yet on the said representation. 4.

In view of the same, respondents 2 to 6 are directed to dispose of the representation, dated 13.10.2016, of the petitioner in accordance with law, within a period of eight (8) weeks from the date of receipt of a copy of this order. 5.

With the above direction, the Writ Petition is disposed of. Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence. No order as to costs.
