Gurrala Muni Reddy, S/O Muni Reddy, v. The Superintendent Of Police, Kadapa, Kadapa District.
HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition No. 28059 of 2012 Order:
The petitioners are challenging the opening of rowdy sheets against them. They state that they are residents of Narayanapalli village, Duvvur Mandal, Kadapa District. They were implicated in the criminal cases due to political rivalry. All the criminal cases were ended in acquittal. In spite of the same, when the police are frequently visiting their houses and asking them to come to police station for investigation, the present Writ Petition was filed.
2. A counter affidavit was filed stating that the petitioners were involved in as many as 13 cases. Out of the said 13 cases, they were bound over in 7 cases, they were acquitted in 4 cases, one case was referred as false and in one case i.e., SC No.306 of 2011 the petitioners are facing trial. The counter affidavit further states that after obtaining permission from the Sub-Divisional Police Officer, Mydukur, Kadapa District, on 11.09.2011, the rowdy sheets were opened as per the Standing Orders of AP Police Manual and they were continued up to 31.12.2012.
3. Learned counsel for the petitioners submits that even in SC No.306 of 2011 the petitioners were acquitted on 15.11.2014 and, hence, no cases are pending against the petitioners.
4. In the circumstances, in the absence of any information with regard to latest position, this Court is inclined to dispose of the writ petition by directing the first respondent to review the case of the petitioners and pass appropriate orders with regard to continuance of rowdy sheets, if they are being continued, and communicate the said order to the petitioners within a period of three (3) months from the date of receipt of a copy of this order.
5. The Writ Petition is, accordingly, disposed of. However, in the
circumstances, no costs.
6. As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
