HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.4148 OF 2015 O R D E R :

This writ petition is filed against the show cause notice dated 21.01.2015, issued by the 3rd respondent asking the petitioner as to why the cheque power should not be withdrawn by exercising power under Rule 42(1) of the Andhra Pradesh Panchayat Raj Act, alleging certain irregularities and also directing the petitioner to submit explanation within one week. Thereafter, the petitioner submitted explanation dated 28.01.2015, but no orders are passed. Aggrieved by the show cause notice, present writ petition is filed.

Heard both sides.

It is not the case of the petitioner that the impugned notice is without jurisdiction and the same is passed in violation of principles of natural justice. In the absence of the same, I do not understand on what ground the petitioner has challenged the impugned show cause notice dated 21.01.2015. Even, the learned counsel for the petitioner is not able to explain how the impugned notice is illegal and erroneous. Even though it is stated that the impugned notice is vague, but some particulars are given. If petitioner requires any further information he can seek the same and respondents shall furnish the same. After giving opportunity of hearing, the respondents may pass orders within a period of four

(4) weeks from the date of receipt of a copy of this order. A perusal of the impugned order goes to show that it is only a show cause notice; though it is alleged that it contains order. In view of the above, the writ petition is misconceived, premature and devoid

of merits, as such, the same is liable to be dismissed. Accordingly, the writ petition is dismissed. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
