HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.28966 OF 2018 ORDER:

The present writ petition came to be filed seeking to declare the action of the respondents in not considering the representation of the petitioner dated 14.2.2018, as illegal and arbitrary. The averments made in the writ affidavit would show that that the husband of the petitioner worked in Indian Army, and extended his services from 1942 to 1950 in the Kashmir boarder and after the end of the second world war, the Government allotted lands to 66 members under ex-servicemen quota. At that time, when the political leaders tried to interfere with the lands allotted, all the 66 members, they filed W.P.No.17795 of 1988 before this Court seeking a direction to the respondent authorities, to issue individual pattas to all the members.

The said writ petition was disposed of directing the respondents authorities therein to consider the representation of the petitioners for grant of individual pattas, but till now the respondent authorities did not issue any pattas to the petitioners, even though the petitioners are in possession of the said property admeasuring Ac.4.50 cents situated at Sy.No.1063, Ac.3.40 cents situated at Sy.Nos.1036 and 1059-1058. It is further stated that the husband of the petitioner died on 10.11.1994 and after his death, petitioner submitted an application on 23.8.2017 to the 2nd respondent to grant pattadar passbooks and to fix the boundaries to the property, which was forwarded by the 2nd respondent to the 4th respondent for necessary action and report compliance, but the 4th respondent failed to take any action.

Having regard to the facts and circumstances of the case, the writ petition is disposed of permitting the petitioner to make an application through online in the prescribed format, enclosing the necessary documents, in which event, the respondent-authorities, shall deal with the matter and pass appropriate orders, in accordance with law, as early as possible, preferably within a period of three to four months from the date of submitting the application, after hearing the petitioner and all the concerned.

With the above direction, the writ petition is disposed of. No order as to costs. As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
