HONOURABLE SRI JUSTICE P.NAVEEN RAO ORDER:

The grievance of the petitioner is that the neighbour to the petitioner is undertaking construction of the building in the adjacent property by illegally encroaching into the property of the petitioner and without obtaining building permission from the Greater Warangal Municipal Corporation.

Learned standing counsel for Greater Warangal Municipal Corporation, on instructions, submits that 5th respondent did not obtain building permission and having come to know about the illegal construction being made by the 5th respondent, appropriate steps are being taken in accordance with the provisions of Greater Hyderabad Municipal Corporation Act, 1955 and the Corporation is in the process of issuing notice under Section 636 of GHMC Act, 1955. 3.

In view of the same, cause in the writ petition does not survive and writ petition is accordingly dismissed. It is made clear that this writ petition is disposed of based on the submissions of the learned standing counsel for Greater Warangal Municipal Corporation on the proposed action taken against alleged illegal construction. This order does not take away the right vested in the 5th respondent to agitate any action that is being initiated against her. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
