THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.19789 of 2004 ORDER:

The writ petition is filed under Article 226 of the Constitution of India seeking a writ of Mandamus declaring the order of the Labour Court-II, Hyderabad in M.P.No.65 of 2002 dated 13.07.2004 as arbitrary, null and void and consequently hold that the respondent-workman is entitled to only Rs.3,782/- towards wages at half pay for the "put-off duty" period from 16.05.1994 to 13.09.1994 and to pass such other necessary orders. On 29.12.2010 this Court passed the following order: "Learned counsel for the petitioner is permitted to take out personal notice to respondent No.1 by registered post with acknowledgment due and file proof of service within six weeks. If for any reason, the notice is not served, the same shall be brought to the notice of the Registry without fail. In default, the writ petition stands dismissed against respondent No.

1 without further reference to the Court." A perusal of the record reveals that the petition against the contesting respondent was dismissed long back. No cause of action survives in the writ petition in view of the dismissal of the petition against the first respondent.

Hence, the writ petition is dismissed. Consequently, the miscellaneous petitions if any pending in this writ petition shall stand closed.
