THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM CONTEMPT CASE No.1527 of 2017 ORDER:

This Contempt Case is filed alleging non-compliance of the order, dated 11.05.2017, passed by this Court in Writ Petition No.16897 of 2017.

By the aforesaid order, this Court disposed of the writ petition by directing the respondent herein not to take coercive steps, including demolition of the compound wall, without considering the representation, dated 27.03.2017, submitted by the petitioner.

On an earlier occasion, learned counsel for the respondent produced before this Court a copy of proceedings, dated 18.05.2017 issued by the respondent and on perusing the same, this Court observed that the said proceedings appeared to have been issued in haste and thereby, issued a direction to the respondent to inspect the site in question and issue notice to both the parties so as to ensure the possibility of amicable settlement between them, if not, to pass appropriate orders in accordance with law.

Today, when the matter is taken up, learned counsel for the respondent asserts that the respondent passed order, dated

26.07.2018 after considering the representation of the petitioner, as directed by this Court. He also produced before this Court a copy of the said order.

Learned counsel for the petitioner submits that while passing the aforesaid order, the respondent had ignored the fact that the said road of 9 feet ends with the petitioner's property. In the light of the fact that the respondent passed order, dated 26.07.2018 in compliance with the directions issued by this Court, the Contempt Case is closed. It is made clear that if the petitioner is not satisfied with the said order, he may avail alternative remedy by way of filing a suit before the civil Court, which is better equipped to take evidence for resolving the dispute.
