THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE N.BALAYOGI WRI T PETI TI ON No.2769 of 2017 ORDER: (per SK,J) This writ petition is filed seeking implementation of the order dated 26.02.2016 passed by the Andhra Pradesh Administrative Tribunal, Hyderabad, in O.A.No.644 of 2016. By the said order, the Tribunal directed the Greater Hyderabad Municipal Corporation to review the suspension of the petitioner herein in terms of G.O.Ms.No.86 dated 08.03.1994 and take a decision regarding his continuance or otherwise under suspension keeping in view the nature of the charges levelled against him. This exercise was directed to be completed within four weeks from the date of receipt of a copy of the order. When this writ petition was listed for admission before this Court on 30.01.2017, Sri P.Keshava Rao, learned Standing Counsel for the Greater Hyderabad Municipal Corporation, sought time to get instructions as to the implementation of the aforestated order. Though four weeks have passed, a request is once again made today for further time to get instructions.

We are however not inclined to accept this request as the Tribunal has merely passed an innocuous order requiring the authorities to review the suspension of the petitioner in terms of the relevant Government Orders and keeping in mind the nature of the charges levelled against him. It is not open to the authorities to fail to review the suspension of an employee periodically in terms of the relevant orders in the event the disciplinary proceedings are not completed.

We therefore dispose of the writ petition directing the first respondent - Greater Hyderabad Municipal Corporation, Hyderabad, to abide by and implement the order dated 26.02.2016 passed by the Andhra Pradesh Administrative Tribunal, Hyderabad, in O.A.No.644 of 2016 expeditiously and, in any event, not later than four weeks from the date of receipt of a copy of this order.
