HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 31335 of 2017 ORDER:
1) Inaction on the part of the respondents in not considering the representations of the petitioners dated 16.02.2017 and 21.06.2017, made pursuant to the order of this Court dated 12.06.2017 passed in W.P.No.18744 of 2017, is subject matter of challenge in the present writ petition.
2) Though various grounds are raised, learned counsel for the petitioners submits that pursuant to an order passed by this Court in w.P.No.18744 of 2017, the petitioners herein have made an application before the Tahsildar on 21.06.2017 for deletion of their lands from the prohibited. The inaction of the Tahsildar is subject matter of challenge in the present writ petition. 3) The Government Pleader for Revenue would submit that the petitioners should have made an application before the committee constituted under the Act and that the Tahsildar has no jurisdiction to deal with the same. At this stage, learned counsel for the petitioners would submit that since the application came to be made pursuant to a direction of this Court, the Tahsildar may be directed to pass an order in accordance with law.
4) Without going into the merits of the case, the present writ petition is disposed of directing the Tahsildar, to pass orders on
the representation dated 12.06.2017, made by the petitioner, in accordance with law, as early as possible, preferably, within a period of eight to twelve weeks from today.
5) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs.
