HONOURABLE SRI JUSTICE P.NAVEEN RAO ORDER:
Petitioner claims to be the owner and in possession of land to an extent of Ac.1.33 cents in R.S.No.113/1 of Pedanindra Kolanu village, Nidamarru, West Godavari district. Petitioner claims to have purchased the said property on 16.12.2011. Petitioner apprehends that treating the property owned by him as Government land he is sought to be dispossessed. Apprehending dispossession, this writ petition is filed.

Learned Government Pleader, on instructions, submits that subject land is Government land and was originally assigned to other persons and, therefore, petitioner cannot claim as private owned land. On the issue of possession, there is no clear instruction. Petitioner asserts that he is in possession. 3.
The Tahsildar (4th respondent) is directed to ascertain the possession of petitioner. If the petitioner is in possession of the land, the Tahsildar shall follow due process before seeking to evict him from the subject land. Writ petition is disposed of accordingly.
