THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.7827 OF 2016 ORDER:

This petition is filed by the petitioner-accused No.2 under Section 438 Cr.P.C. seeking to grant bail in PRC No.9 of 2016 on the file of the Additional Judicial Magistrate of First Class, Nuzvid. Heard and perused the material available on record. It is alleged that the petitioner along with two other accused committed the offence punishable under Sections 306 and 420 r/w 34 IPC. It is alleged that the deceased, his daughter and son-in-law mortgaged the land with A1 through the petitioner and another for Rs.3,20,000/-.

Later when the deceased approached A1 for cancellation of mortgage deed, A1 demanded Rs.32 lakhs and threatened the deceased stating that if the money of Rs.32 lakhs was not paid, he will take the land. On 19.8.2015 the deceased was necked out from the house of A1. Then, the deceased committed suicide.

The learned Additional Public Prosecutor while opposing this petition submitted that NBWs were issued against the petitioner. Considering the facts and circumstances of the case, this Court is inclined to pass the following order:

The petitioner-accused is directed to surrender on or before 30th June, 2016 and move an application before the Court below concerned to recall NBWs issued against him and on such application being filed, the Court below is directed to recall NBWs issued against the petitioner and release him on bail on his executing a personal bond for a sum of Rs.5,000/- (Rupees Five Thousand only) with one

surety for the like sum. The petitioner is directed to appear before the Court below on all hearing dates.
