THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.13079 OF 2025 ORDER :

This criminal petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioner/A.1 seeking anticipatory bail in connection with Crime No.1667 of 2025 of Gachibowli Police Station, Cyberabad. The offences alleged against the petitioner are under Sections 69, 115(2), 74, 351(2), 318(4) of Bharatiya Nyaya Sanhita, 2023. 2.

The case of the prosecution is that the defacto complainant lodged report before police on 29.07.2025 wherein it is stated that the petitioner herein was introduced by her friend in the year 2021 and they got acquainted with each other and developed friendship. The complainant was unaware that the petitioner was married and that he was single, as such, they entered into a relationship. In September 2021, they met physically at a hotel White Ridge, Jagruthi Colony, Kondapur, where petitioner used to stay regularly. Since then they were physically involved multiple times and later she came to know that petitioner was married and when she asked for marriage, he stated that he would marry her after giving divorce to his wife and trusting his promise of marriage she continued her relationship with the petitioner and he also undertook to take

- 2 - care of her son. Petitioner also lured amount from her and she also contributed partial loan amount towards purchase of car and his loan is paid by the complainant. It is further stated that the mother of petitioner foisted false case against her. As such petitioner not only cheated her, but extracted money from her and also physically assaulted her multiple times, when she asked for return of her money. Hence, requested the police to take action against the petitioner. Basing on the said complaint, police registered the case against the petitioner. 3.

Heard Sri Prashanth Gadipe, learned counsel for the petitioner and Sri D.Arun Kumar learned Additional Public Prosecutor appearing for the respondent-State. 4.

The contention of learned counsel for the petitioner is that the petitioner and complainant are already married and they are in consensual relationship, as such, there is no offence under Section 69 of the BNS. In fact petitioner's mother had already lodged a report before the police against the complainant as she cheated the petitioner herein. There is no such offence committed by the petitioner, as such, requested this Court to grant bail to the petitioner.

On the other hand, learned Additional Public Prosecutor on instructions, would submit that the allegations against the

- 3 - petitioner are heinous in nature and custodial interrogation of the petitioner is required for further investigation and requested this Court to dismiss this petition.

Considering the submissions made by both the counsel and the material on record, the complaint shows that the petitioner and complainant are already married persons and they were in relationship. No divorce is also obtained by the petitioner from his wife or the complainant from her husband. Considering the facts and circumstances of the case, this Court deems it fit to grant bail to the petitioner subject to the following conditions :

i.

The petitioner/Accused shall surrender before the Station House Officer, Gachibowli Police Station, Cyberabad, within two weeks from today, and on such surrender, the said Station House Officer shall release the petitioner on bail on his executing a personal bond for Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties, for the like sum each.

ii.

The petitioner/Accused shall appear before the concerned SHO at 11:00 a.m., on every Wednesday for a period of eight

(8) weeks, for the purpose of investigation and thereafter, as and when required.

iii.

The petitioner/Accused shall abide by the other conditions stipulated in Section 482 (2) of BNSS and co-operate with the Investigating Officer in investigating the case.

Accordingly, this Criminal Petition is allowed. Miscellaneous petitions, if any, pending shall stand closed.
