THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.38428 of 2012 ORDER:

The grievance of the petitioners was that the Inspector of Police, Alwal Police Station, Cyberabad, Hyderabad, was interfering in their civil litigation and pressurizing them to withdraw O.S.No.256 of 2012 filed by them against one S. Prakash Reddy and others. The Inspector of Police, Alwal Police Station, Cyberabad, filed a counter-affidavit stating that on the complaint lodged by one S. Prakash Reddy with the Alwal Police Station, Crime No.695 of 2012 was registered on the file of the said police station under Sections 427 and 447 I.P.C. The petitioners were shown as accused Nos.1 and 2 therein. The investigation in the said crime was stated to be at the initial stage. The Inspector of Police further stated that the police authorities had never interfered with the civil litigation of the petitioners.

As the afore-stated counter was filed as long back as on 26.12.2012, the learned Assistant Government Pleader for Home was asked to get instructions as to the present status. Thereupon, the learned Assistant Government Pleader placed before this Court a copy of the final report under Section 173 Cr.P.C. which was filed before the learned VI Metropolitan Magistrate, Cyberabad, at Medchal, in relation to Crime No.695 of 2012 on the file of Alwal Police Station. Under the said report, the police authorities referred the case as of civil nature. In the light of the afore-stated developments, it is clear that the offence which was registered against the petitioners in Crime No.695 of 2012 has come to its logical end upon the filing of a final report by the police authorities under Section 173 Cr.P.C. The stand of the police authorities that they are not interfering with the civil disputes and the civil litigation of the petitioners is duly taken on record. The cause in the writ petition therefore does not survive for adjudication on merits.

The writ petition is accordingly closed. Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs. ____________________ JUSTICE SANJAY KUMAR 8th September, 2015 IBL
