THE HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.6888 of 2017 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief: "to issue writ of mandamus to declare the action of the Respondent No.3 for not taking any action on the complaint dated 27-12-2016 made by the petitioner to the respondent No.3 by not taking any action with regard to the illegal construction made by respondent No.6 over the property in respect of the property bearing No.9-1-41/25, admeasuring 103 sq. yards, out of total admeasuring 375 sq. yard situated at Langer House, Hyderabad and declare the same as illegal, against law, violation of principles of natural justice and against the provisions GHMC Act."

Heard, Sri Suresh Shiv Sagar, learned counsel for the petitioner, learned Government Pleader for Municipal Administration for respondent No.1, Sri N. Ashok Kumar, learned Standing Counsel for respondents 2 and 3 and learned Government Pleader for Home for respondent No.4. When the matter is taken up, learned counsel for the petitioner seeks permission of this Court to close the writ petition with a liberty to the petitioner to approach the Civil Court seeking appropriate relief against the private respondents 5 and 6.

Recording the said submission, the writ petition is closed, giving liberty to the petitioner, as prayed for. There shall be no order as to costs.

The Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
