THE HON'BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON'BLE SRI JUSTICE SANJAY KUMAR PUBLIC INTEREST LITIGATION NO.29 of 2015 ORDER: (per the Hon'ble The Chief Justice Sri Kalyan Jyoti Sengupta) At this stage, we are not going into the merit of the matter as we find that there has been inaction on the part of the official respondents in not taking steps pursuant to the complaint made by the petitioner. The petitioner has made number of complaints, one of such complaint is addressed to the District Collector, Kadapa, alleging that the bore well dug by the Government is not made operational by fitting appropriate motor. However, some private people taking advantage of this inaction, have fitted their own motor to the bore well and are illegally extracting the drinking water.
We think that the complaint is serious in nature. We therefore direct the District Collector, Kadapa, to enquire into the complaint himself and while doing so, he will give notice and information to all persons concerned. Thereafter, if he finds that the allegations are correct, then appropriate remedial measures shall be taken. This exercise shall be completed within eight weeks from the date of communication of this order.
The Public Interest Litigation is accordingly disposed of. Pending miscellaneous petitions, if any, shall also stand dismissed. There will be no order as to costs. _______________________ K.J. SENGUPTA, CJ _______________________
