THE HONOURABLE Dr.JUSTICE B.SIVA SANKARA RAO Criminal Petition No.9175 of 2017 ORDER :

Heard the learned counsel for the petitioner/ A.1 in Cr.No.64 of 2017 of Mominpet Police Station registered for the offences punishable u/ sec.324,504 and 506 r/ w 34 IPC and also the learned Public Prosecutor representing the 1st respondent-State before ordering notice to the 2nd respondent/ defacto-complainant and perused the grounds urged in the quash petition and the contents of the First Information Report.

The contention of the learned counsel for the quash petitioner of delay in report occurred of more than 8 days because of beating by police but the medical report showing as out of heavy gym work he became sick.

Having regard to the above and in the result, the Criminal Petition is disposed of. The investigation shall go on however the petitioner shall not be arrested pending investigation and it is made clear that this will not prevent the police to secure presence of the petitioner for the purpose of investigation.
