This writ petition is filed under Article 226 of the Constitution of India for the following relief - " For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased issue a Writ, Order, or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondent nos.2 to 6 harassing the petitioner to deliver the possession of the property land admeasuring Ac.3.02 guntas in Sy.No.1113 and Ac.2.16 guntas in Sy.No.1115 in total admeasuring Ac.5.18 guntas situated in Dhjarmapuri Village and Mandal, Karimnagar District to the respondent No.
7 and 8 without therebeing a court order, as illegal, arbitrary and violative of Article 14 and 21 of the Constitution of India and to pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case." When the matter is taken up for consideration, written instructions dated 11.8.2015 furnished by the Station House Officer, Dharmapuri Police Station, Karimnagar District has been placed on record by the learned Government Pleader for Home and the relevant portion of the same reads as under : " It is respectfully submitted that as per the records, it is revealed that no complaint or case whatsoever was received or registered against the petitioners herein on the file of Dharmapuri Police Station, Karimnagar District.
It is submitted that the allegations of the petitioner that on the strength of the status quo order passed in IA No.256/2015 in O.S.No.66/2015 dt.21.5.2015, it seems that the 8th respondent approached the police and managed them to recover the possession of the property from them and that on 5.7.2015 while they were doing agricultural works, the 7th and 8th respondents along with the police of Dharmapuri Police Station have came to their land and restrained them from doing agricultural works and that the police of Dharmapuri are harassing them to deliver the possession of the land to the 8th respondent are absolutely false, baseless and more particularly invented for the purpose of filing the present writ petition.
It is submitted that the allegation of the petitioner that the 6th respondent is frequently coming to the land along with police constables and torturing them by abusing them in filthy language to deliver the possession of the land to the 8th respondent and threatening them to face dire consequences is absolutely false and hence denied.
It is pertinent to submit that the dispute of the petitioners as well as the unofficial respondents 7 and 8 herein is purely civil in nature and having bore grudge against them, the petitioners made baseless and false allegations against this respondent police.
I humbly submit that at no point of time, this respondent interfered with the civil disputes and nor asked the petitioners to come to the police station or delivered the possession of the subject lands in question to the unofficial respondents herein. As a precautionary measure to prevent the police from taking any action in the event of lodging of any complaint, they rushed to this Hon'ble Court and filed the
present writ petition with false allegations." Noticing the said instructions, learned counsel for the petitioner requests to dispose of the writ petition by recording the above written instructions dated 11.8.2015.
In view of the above, the writ petition stands disposed of by recording the above written instructions dated 11.8.2015 furnished by the Station House Officer, Dharmapuri Police Station, Karimnagar District. Miscellaneous applications, if any pending in the writ petition, shall stand closed.
