THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.41124 OF 2016 ORDER :

Heard learned counsel for the petitioner and Sri Chatla Madhu, learned Standing Counsel for the respondents 3 and 4. This writ petition is filed challenging the impugned notice under Section 452 (2) of Hyderabad Municipal Corporation Act, 1955 dated 08.11.2016.

Learned counsel for the petitioner submits that though the petitioner purchased the land in Sy.Nos.440, 441 and 442 situated at Dwarakamai Colony, Old Safilguda, Malkajgiri, R.R.District, through valid registered sale deed, the respondents have issued the impugned notice. He submits that before submitting explanation to the said notice, the respondents are trying to demolish the structure.

A perusal of the impugned notice shows that only three

(3) days time was granted for submitting explanation. Learned counsel for the petitioner submits that they will file explanation to the impugned notice within two weeks. Recording the submission of the learned counsel for the petitioner, the petitioner is permitted to file explanation to the impugned notice within a period of two weeks from the date of receipt of a copy of this order. However, petitioner shall not make any further construction over the subject land. On such application, the respondents shall consider the same and pass

appropriate orders, in accordance with law. Till then, status quo obtaining as on today shall be maintained.

With the above observation, this writ petition is disposed of. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, shall stands closed. ____________________________ A.RAJASHEKER REDDY, J 25.11.2016 kvs
