HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO Criminal Petition No.8639 of 2018 ORDER :

The petitioners are the A.2, A.4, A.6 and A.8 among 8 or more accused in Cr.No.62 of 2017 of Puttaparthy Rural Police Station under Sections 341, 354, 324 and 506 read with 34 IPC and under Section 3(1)®(s) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act, 1989 (for short, 'the Act'), and in the course of investigation added Section 326 IPC also.

The petitioners since went unsuccessful earlier in seeking anticipatory bail including before this Court in Crl.P.No.2843 of 2018 by its order, dt.15.03.2018, where only Section 41-A CrPC protection was given referring to Arnesh Kumar Vs. State of Bihar 1, dt. 15.03.2018, moved the present anticipatory bail application again. Heard the learned counsel for the petitioners and the learned Public Prosecutor in opposing the same and perused the First Information Report, bail application averments and remand report of A.1, A.3, A.5 and A.7, dt.09.02.2018 and perused the material on record. Undisputedly the accused person A.1 was enlarged on regular bail vide order of the leaned VIII Addl.Sessions Judge, Anantapur in Crl.P.No.244 of 2018, dt. 13.03.2018 as the A.3, A.5 and A.7 were already enlarged on.

On perusal of the First Information Report it speaks about the general allegation against all the accused persons abused touching caste and beat them and so far as the grievous injury alleged to be caused including abusing on caste is concerned, it is mainly by A.1 B.Nagaraju. 1 (2014) 8 SCC 273

Having regard to the above, otherwise it is a case for anticipatory bail, so far as the petitioners are concerned by virtue of the bar, rather dismissal, the application is disposed of giving liberty to the petitioners as of they are ladies and housewives to surrender before the learned Sessions Judge with a notice to the learned Public Prosecutor and move for regular bail for the learned Sessions Judge, to grant bail on the same day preferably.

Miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed.
