THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.9768 OF 2022 O R D E R:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure (for short "Cr.P.C") seeking regular bail to the petitioner who is arrayed as Accused No.1 in Crime No.328 of 2022 pending on the file of Station House Officer, Chaderghat Police Station, Hyderabad registered for the offence punishable under Section 8(c) read with Section 22 (c) and 27 of NDPS Act. 2.

Heard learned counsel for the petitioner-Accused No.1 and learned Additional Public Prosecutor for the respondent-State. Perused the record.

The case against this petitioner is that he was found in possession of 12 LSD blots and 250 grams of dry ganja. 4.

This Court by order dated 28.10.2022 dismissed the bail application of this petitioner on the ground that he was selling the drugs. However, the allegations made in the remand report are on the basis of confession and there is no evidence that was collected by the police during the course of investigation.

Keeping in view that the petitioner is aged around 20 years, he can be granted the relief of regular bail who is in judicial custody since 24.08.2022.

Accordingly, the Criminal Petition is allowed and the petitioner-Accused No.1 is granted bail subject to the following conditions:

i) The petitioner-Accused No.1 is directed to be released on bail on his executing personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for a like sum each, to the satisfaction of VIII Additional Chief Metropolitan Magistrate, Hyderabad at Nampally.

ii) After release on bail, the petitioner-Accused No.1 shall appear before the concerned Station House Officer on every Monday and Thursday between 10.30 AM and 01.00 PM for a period of eight (08) weeks and thereafter as and when required for the purpose of investigation.

iii) The petitioner-Accused No.1 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.
