HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL PETITION No.3633 of 2015 ORDER:
The instant petition is filed, under Section 482 of the Code of Criminal Procedure, 1973 (for short 'Cr.P.C.'), requesting to quash the proceedings in FIR.No.72 of 2015 of Sultan Bazar Police Station, Hyderabad, for an offence punishable under Section 3(1)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (for short 'the Act'), said to have committed by the petitioners, who are arraigned as A.1 and A.2 respectively. Leaving apart the case projected in the complaint, learned counsel for the petitioners, while pleading innocence and false implication of the petitioners, submits that other civil litigations, pending between the petitioners and owners of the land, were compromised before Lok Adalat on 27.04.2015, and a copy of the award is yet to be received, in which the owner of the land has also mentioned that the instant crime would be withdrawn by putting an end to the litigation pending in the Courts.
Learned Additional Public Prosecutor appearing for the Telangana State opposed the request.
However, keeping in view that, in case, the award is passed, and there is reference to the instant crime, the petitioners can move the Court by filing yet another application as, at the moment, no material is placed to substantiate that there is abuse of process of law.
Keeping in view the aforesaid submission, the Sultan Bazar Police, Hyderabad are directed not to arrest the petitioners during the course of
investigation, and the petitioners shall appear before the police as and when required for investigation.
For the present, the Criminal Petition is disposed of . As a sequel thereto, miscellaneous applications, if any, also stand disposed of.
