O R D E R

Alleging that respondents 6 and 7 - police authorities are encroaching the subject land for the purpose of constructing commercial complex, the present writ petition is filed for a direction restraining them from proceeding with the construction.

Heard the learned counsel for the petitioner. Learned Assistant Government Pleader for Home produced written instructions of Sub Inspector of Police, Kalakada Police Station, Chittoor District, dated 20.08.2018, stating that the allegation of the petitioner that respondents 6 and 7 are trying to encroach into the subject land, which was granted to them, is false and baseless. As per records, the subject land was allotted to APSRTC Bus Stand and Police Parade ground respectively by the Collector, Chittoor vide Roc.No.E1/ 8081/ 99 dated 18.09.1999 and the mutation was also made in the revenue records, and as per the orders of the Director General of Police, Andhra Pradesh vide Memorandum in Rc.No.230/ V3/ 2017-18 dated 10.05.2018, police welfare commercial complex was constructed.

Both parties are trying to lay claim on the subject property and these disputed questions of fact cannot be resolved in the writ petition. In view of above facts and circumstances, writ petition is dismissed. However, it is open to the petitioner to avail alternative remedies available under law.

Interlocutory applications pending, if any, shall stand closed. No costs.
