Heard the learned counsel for the petitioners-accused Nos.4 and 5 and the learned Public Prosecutor for the State. Perused the record.
Learned counsel for the petitioners-accused Nos.4 and 5 contends that there is no cause of action against the petitioners and unnecessarily they have been roped into the crime and ultimately, prayed to quash the FIR in Crime No.231 of 2017 on the file of the Ramachandra Puram Police Station, Cyberabad. Learned Public Prosecutor submitted that there are specific allegations against the petitioners-accused Nos.4 and 5 and therefore, it is not a fit case to quash the FIR against them. The material on record reveals that there are specific allegations of suppression of first marriage between the de facto complainant-respondent No.2 and accused No.1, constituting offence under Section 494 of the Indian Penal Code and other penal provisions, it is not proper to quash the FIR and prevent the police from investigating into the crime.
The Criminal Petition is devoid of merits and is dismissed. Miscellaneous petitions, if any, pending shall stand dismissed. _____________________________ (DR. SHAMEEM AKTHER, J) 27th July 2017 RRB
